Community associations face the unfortunate risk of being sued for the decisions they make or for the condition of the property they own or maintain. When this occurs, the first step is to submit the lawsuit to insurance to see if coverage is provided under the Association’s General Liability or Directors and Officers Liability policies. The need to understand the coverage provided by liability policies, and their inter-relationship, has never been more important or more challenging. This class will help directors understand the basics of liability insurance, the difference between General and Directors and Officers liability policies, the kinds of claims covered, who is covered, and which Directors and Officers policies provide the most comprehensive coverage. We will also discuss the difference between liability and first-party insurance and how having adequate first-party insurance can decrease the likelihood of being sued in the first place in certain situations.
