Melinda K. Banks

Melinda K. Banks serves as general counsel to condominium and homeowner association boards of directors. She advises boards of directors and property managers on the day-to-day legal issues, management and operational aspects of governing their communities. Melinda’s practice also includes drafting, interpreting and amending association legal documents, transitioning from developer to owner control, helping associations prepare for and run efficient meetings, enforcement of association covenants, and reviewing contracts. Melinda has helped numerous associations navigate and resolve covenant, easement, and zoning issues in their communities and with neighbors. She also represents community associations in alternative dispute resolution, litigation, and foreclosure matters.
Melinda contributes to NowackHoward’s client resource library and enjoys teaching board member education and manager continuing education seminars as part of the NowackHoward academy. She also enjoys counseling clients on recently decided case law that affects community associations and on proposed laws that could impact community associations. Melinda understands that community association boards of directors are often comprised of busy volunteer homeowners and she enjoys working with board members to help develop their understanding of directors’ legal rights and obligations.
Melinda has also worked with condominium and homeowners associations throughout Georgia to provide assistance and guidance with collection strategies and collections practices. Melinda has experience litigating real estate-based contract suits from inception through judgment collections, and her background also includes assisting clients with federal and state consumer protection law compliance and representing associations in bankruptcy proceedings. Melinda joined NowackHoward after serving as an attorney at Weissman, Nowack, Curry & Wilco. Melinda has significant experience in collections, real estate closings, community association law, and post-conviction criminal advocacy.
A member of Georgia Bar, Melinda is admitted to practice in Georgia State, Appellate, and Supreme Courts and the U.S. District Court for the Northern District of Georgia. She is also a member of the Community Associations Institute of Georgia and currently serves on the Spring Fling Committee. Melinda is an active member of the Atlanta Bar Association, the Georgia Association for Women Lawyers, and the Stonewall Bar Association. In addition to her law degree, Melinda earned a certificate in Advanced Legal Writing, Research, and Drafting.
